Thirty years of marriage builds more than memories. A home along South Fletcher. Retirement accounts, a club membership, maybe a business that lives by tourist season. Divorce at this stage is less about blame and more about protecting what took a lifetime to build, and deciding carefully what the next chapter should cost. We quote one fixed fee, in writing, before you hire us, with no hourly meter running behind it.

The Plain-English Answer for Amelia Island
A divorce on Amelia Island is a Florida case filed in Nassau County. One spouse files a petition with the Nassau County Clerk of Courts stating the marriage is irretrievably broken, and no one has to prove fault. Florida then divides marital property and debts, and long marriages usually turn on how that division gets done. The court needs two things:
- Grounds: the marriage must be irretrievably broken, the no-fault standard set by Fla. Stat. § 61.052.
- Residency: at least one spouse must have lived in Florida for the six months before filing, under Fla. Stat. § 61.021.
Local pro tip: Your case is not filed or heard on the island. Filings go to the Nassau County Clerk, almost entirely electronically, and hearings happen at the Robert M. Foster Justice Center, 76347 Veterans Way, in Yulee. Many clients never make the drive unless a hearing requires it.
Local Knowledge, From the South End to the Courthouse
From the resort corridor on the south end, the Foster Justice Center in Yulee is roughly 25 to 30 minutes away: north on First Coast Highway (A1A), then west off the island. In practice you may never need the trip. Nassau County divorce work files electronically, and we handle the courthouse side so you can stay home.
The island is not one market, either. A settlement involving a home near American Beach, the historic community founded for employees of A.L. Lewis's Afro-American Life Insurance Company, raises different valuation questions than a golf villa in the Omni corridor or a place in Amelia City. Club memberships, rental income, and second homes all have to be sorted into marital and nonmarital before anyone talks about splitting them, and knowing the difference changes how the numbers get negotiated.
What a Divorce Actually Looks Like From the Island
- One free ten-minute call. Ten minutes, from your kitchen or a quiet table at Amelia Island Coffee. If we are a fit, the next step is a one-hour consultation with an attorney, $150 prepaid, and you leave it with your total fixed price in writing.
- Filing with the Nassau County Clerk. We file your petition with the Nassau County Clerk of Courts, almost always electronically. Many Florida counties also enter a standing order at filing that sets ground rules for both spouses while the case is open, and we walk you through it if yours does.
- Service and the 20-day clock. Your spouse is formally served and has 20 days to respond under Rule 12.140(a)(1).
- Mandatory disclosure. Within 45 days, both sides exchange financial documents under Fla. Fam. L. R. P. 12.285. In a long marriage, this is where the full picture of the estate comes out: pensions, brokerage accounts, real estate, and business interests. One more thing worth knowing: in a fully agreed case, your spouse typically accepts service instead of being formally served, and the two of you can often waive the document exchange by agreement, which is part of why agreed cases move faster.
- Mediation, then the final hearing if needed. Most cases settle in private mediation with an experienced mediator both sides choose, scheduled around your life rather than a court calendar. If yours needs a judge, we request a final hearing at the Robert M. Foster Justice Center in Yulee.
Counselors and Financial Planners Near Amelia Island
After a long marriage, the money questions can be bigger than the legal ones: two households now run on assets that were built for one retirement. A financial planner can model what keeping the house versus splitting the accounts costs over twenty years. A counselor helps you grieve a long marriage without letting that grief drive settlement decisions. Getting both in place before mediation tends to make the case smoother. If faith is part of how you get through hard seasons, our Chaplain Care Service is available too.
- Katie Worley, LMFT, Fernandina Beach, in person and telehealth, (904) 352-8788. A marriage and family therapist with more than 13 years helping couples and families in transition.
- ADvanced Psychological Services, serving Fernandina Beach and Amelia Island, (904) 447-5359. A psychologist practice that lists divorce and couple issues among the concerns it treats.
- John Neff, CFP®, Fernandina Beach, (912) 844-1788. A Certified Financial Planner, the credential that matters when dividing retirement assets in a longer marriage.

Questions Amelia Island Clients Ask First
Do I have to leave the island for my divorce?
Usually only for a hearing, if that. Filings go electronically to the Nassau County Clerk, and cases are heard at the Robert M. Foster Justice Center in Yulee. Many islanders assume court happens locally. It does not.
Is permanent alimony still a thing in Florida?
No. Florida ended permanent alimony in 2023. Fla. Stat. § 61.08 now sets out other forms of support, including durational and rehabilitative support, and the length of the marriage still shapes what fits a case like yours.
Will I lose half of what I built before the marriage?
Assets that are truly nonmarital are generally not divided. Equitable distribution under Fla. Stat. § 61.075 starts from a premise that marital assets split equally. What you brought into the marriage, or inherited and kept separate, is treated differently, and sorting one category from the other is much of the work.
My spouse's income is seasonal and hard to pin down. What then?
Both spouses must exchange financial documents within 45 days under Rule 12.285. Tax returns, statements, and account records come out early in the case. Hospitality and rental income can be documented, and we know where to look.
How long does a divorce take in Nassau County?
A typical uncontested case runs about three months. Fla. Stat. § 61.19 allows a final judgment as early as 20 days after filing, though few cases move that fast. We scope a standard contested case at seven months or settlement. That is how we set the fixed price, not a promise about speed. Complex estates can take longer, and we say so up front.
