Naval Station Mayport sits at the north edge of Atlantic Beach, and Mayport Road runs straight to the gate. Sea duty has a way of finding a marriage's weak seams. Whether you're the spouse holding the household together through another underway period, or you were served while the ship was out, we can tell you what happens next and exactly what it costs, in writing, before you hire us.

The Plain-English Answer for Atlantic Beach
Atlantic Beach divorces are usually Duval County cases under Florida's no-fault law. Neither spouse has to prove wrongdoing. The petition is filed with the Duval County Clerk of Courts, and hearings are held at the Duval County Courthouse, 501 W. Adams St., in downtown Jacksonville. The court needs two things:
- Grounds: the marriage must be irretrievably broken, the no-fault standard set by Fla. Stat. § 61.052.
- Residency: at least one spouse must have lived in Florida for the six months before filing, under Fla. Stat. § 61.021.
Local pro tip: The Duval Clerk keeps a Beaches Branch about five minutes away on Atlantic Boulevard in Neptune Beach. Call the clerk before you go to ask what it can handle. Between that branch and electronic filing, the downtown courthouse trip stays rare.
From Seminole Road to the Courthouse, We Cover the Distance
When a hearing is required, it happens downtown, about 35 minutes away, Atlantic Boulevard west toward the Arlington Expressway. Most steps never require the trip, because filings run electronically and our work runs by phone around your watch schedule, not ours. You'll know well in advance which dates need you in a courtroom, so you can plan leave or childcare around them.
Parenting plans here have to survive a deployment cycle, not just a school year. Atlantic Beach Elementary and Mayport Middle set the weekday rhythm, summers pull kids to the beach and trails at Hanna Park, and a ship's schedule can rearrange all of it. The oceanside streets also hold long marriages with grown children and real retirement savings, which raise a different set of questions. We draft agreements that fit either household.
The Path Through, One Step at a Time
- One free ten-minute call. We listen first, whether you call from the house off Seminole Road or a quiet spot along Mayport Road. If we're a fit, the next step is a one-hour consultation with an attorney, $150 prepaid, and you leave it with your total fixed price in writing.
- Filing with the Duval County Clerk. We file your petition electronically with the Duval County Clerk of Courts, from anywhere. Many Florida counties also enter a standing order at filing that sets ground rules for both spouses while the case is open, and we walk you through it if yours does.
- Service and the 20-day clock. Your spouse is formally served and has 20 days to respond under Rule 12.140(a)(1). Sea duty and deployments make the timing worth planning up front.
- Mandatory disclosure. Within 45 days, both sides exchange financial documents under Fla. Fam. L. R. P. 12.285: pay records, bank statements, and TSP and retirement statements included. One more thing worth knowing: in a fully agreed case, your spouse typically accepts service instead of being formally served, and the two of you can often waive the document exchange by agreement, which is part of why agreed cases move faster.
- Mediation, then the final hearing if needed. Most cases settle in private mediation with an experienced mediator both sides choose. If yours needs a judge, we request a final hearing at the Duval County Courthouse.
Counselors and Financial Planners Near Atlantic Beach
Military divorces carry extra moving parts: deployment schedules, housing allowances, survivor benefits, the retirement math. A counselor who sees Navy families understands what a sea-duty rotation does to a marriage and to kids, and offers steadiness through the change. A financial advisor translates military retirement and civilian assets into a plan for one household at a time. Lining up both before mediation keeps a hard season organized instead of chaotic. If faith is part of how you get through hard seasons, our Chaplain Care Service is available too.

Atlantic Beach and Mayport Divorce Questions
Where are Atlantic Beach divorce cases heard?
At the Duval County Courthouse, 501 W. Adams St., downtown. Filing is electronic, and the clerk's Beaches Branch in Neptune Beach may handle some clerk business closer to home, so most of a case happens without the drive.
Does my spouse automatically get half my Navy retirement?
No. Florida has no automatic half. Retirement earned during the marriage is divided under Fla. Stat. § 61.075 along with the other marital property, starting from a premise of equal and adjusting to the facts. How a Navy pension gets valued and paid is where military cases turn technical, so ask about it on the first call.
How does time-sharing work around sea duty?
Since July 1, 2023, Florida starts from a rebuttable presumption that equal time-sharing is in the children's best interest, and courts decide time-sharing under Fla. Stat. § 61.13. Rebuttable means real-world facts, like an underway schedule, shape the final plan, so a well-drafted Atlantic Beach plan accounts for the deployment cycle up front.
What if I don't know what my spouse earns or has saved?
Both spouses must exchange financial documents within 45 days under Rule 12.285. Many military spouses start exactly there, and the rule exists for them.
How long will it take?
A typical uncontested case runs about three months. Fla. Stat. § 61.19 allows a final judgment as early as 20 days after filing, though few cases move that fast. We scope a standard contested case at seven months or settlement. That is how we set the fixed price, not a speed promise.
