The Plain-English Answer for Horizon West
Florida is a no-fault state, so nobody has to prove blame. For Horizon West residents, a divorce is filed with the Orange County Clerk of Courts and heard in downtown Orlando. Because so many residents here are new to Florida, the residency rule usually comes up first. The court needs two things:
- Grounds: the marriage must be irretrievably broken, the no-fault standard set by Fla. Stat. § 61.052.
- Residency: at least one spouse must have lived in Florida for the six months before filing, under Fla. Stat. § 61.021.
Local pro tip: Horizon West is unincorporated Orange County, so your mail probably says Winter Garden or Windermere. Don't let the address confuse the paperwork. Where the case is filed generally follows where the two of you last lived together, which for a Horizon West home usually means the Orange County Clerk in downtown Orlando.
Built for How Horizon West Actually Lives
Horizon West cases are heard at the Orange County Courthouse, 425 N. Orange Ave., in downtown Orlando, roughly 35 minutes from Hamlin up SR 429 to the 408 East. For a community this busy, the better news is how little of a modern divorce requires the trip: filing is electronic, and much of the rest happens by phone and document exchange.
School zoning here shifts village by village between Horizon High and Windermere High, and a handoff from one village to another at school-run hour can take longer than it looks on the map. We draft time-sharing schedules with that in mind, not a generic template.
The Process, Scheduled Around Real Life
- One free ten-minute call. Even between meetings, it fits. If we're the right firm, the next step is a one-hour consultation with an attorney, $150 prepaid, and you leave it with your total fixed price in writing.
- Filing with the Orange County Clerk. We file your petition with the Orange County Clerk of Courts. Many Florida counties also enter a standing order at filing that sets ground rules for both spouses while the case is open, and we walk you through it if yours does.
- Service and the 20-day clock. Your spouse is formally served and has 20 days to respond under Rule 12.140(a)(1).
- Mandatory disclosure. Within 45 days, both sides exchange financial documents under Fla. Fam. L. R. P. 12.285, including the mortgage on a house bought in a hot market. One more thing worth knowing: in a fully agreed case, your spouse typically accepts service instead of being formally served, and the two of you can often waive the document exchange by agreement, which is part of why agreed cases move faster.
- Mediation, then the final hearing if needed. Most cases settle in private mediation with an experienced mediator both sides choose. Saturday mornings at the new regional park don't have to change. If yours needs a judge, we request a final hearing at the Orange County Courthouse.
Counselors and Financial Planners Serving Horizon West
Most Horizon West divorces involve young kids, two careers, and a house bought near the top of the market, which makes counseling and financial planning practical needs, not luxuries. Therapy helps parents build a co-parenting relationship that will outlast the case by fifteen years. A planner runs the numbers on the mortgage, equity, and childcare so both households can stay on their feet. If faith is part of how you get through hard seasons, our Chaplain Care Service is available too.
- Kerryanne Shea, LMFT, Winter Garden 34787, (321) 329-6088. A Winter Garden marriage and family therapist who works with relationships that have gone off track.
- Moisand Fitzgerald Tamayo, (877) 869-6228. A fee-only planning firm with an Orlando-area location for retirement and asset-division questions.

Horizon West Divorce Questions
We just moved to Florida. Can I even file yet?
Only if you or your spouse has lived in Florida for the past six months. Fla. Stat. § 61.021 sets the residency rule. Many Horizon West families are recent arrivals, so this is often the first question we answer.
Where are Horizon West divorce cases actually heard?
At the Orange County Courthouse, 425 N. Orange Ave., in downtown Orlando. The community has no courthouse of its own. It's about 35 minutes up SR 429 and the 408, though most of your case won't require the drive.
Will one of us automatically get the kids most of the time?
No. Since July 1, 2023, Florida starts from a rebuttable presumption that equal time-sharing is in the children's best interest. Courts decide parental responsibility and time-sharing under Fla. Stat. § 61.13. Those are the terms the statutes use for what most people search as custody, and the presumption can be overcome with evidence. The schedule has to survive two work calendars and a school run across the villages.
What happens to a house we bought at the top of the market?
Its equity, whatever it is, is divided along with the rest of the marital estate under Fla. Stat. § 61.075, which starts from a premise of equal. Whether one spouse keeps the home depends on the mortgage, the payment, and what each household can carry alone.
What if my spouse is hiding money?
Both spouses must exchange financial documents within 45 days under Rule 12.285. Pay stubs, tax returns, and retirement statements surface early, on a deadline.
How long does this take?
A typical uncontested case runs about three months. Fla. Stat. § 61.19 allows a final judgment as early as 20 days after filing, though few cases move that fast. We scope a standard contested case at seven months or settlement. That is how we set the fixed price, not a promise about speed.
