The Plain-English Answer for Ocoee
A Florida divorce is legally called a dissolution of marriage, and Florida is a no-fault state, so nobody has to prove the other spouse did something wrong. For Ocoee residents, the case is filed with the Orange County Clerk of Courts and heard in downtown Orlando. The court needs two things:
- Grounds: the marriage must be irretrievably broken, the no-fault standard set by Fla. Stat. § 61.052.
- Residency: at least one spouse must have lived in Florida for the six months before filing, under Fla. Stat. § 61.021.
Local pro tip: Florida requires divorcing parents of minor children to complete a parent education course before the case can finish. Get it done in the first weeks of the case so it never holds up your finish line.
West Orange Roads We Know
Ocoee divorce cases are heard at the Orange County Courthouse, 425 N. Orange Ave., in downtown Orlando. From most of the city that's Silver Star Road or SR 50 to the 408 East, roughly 25 minutes. We plan cases so most of yours happens on paper and by phone, not in that building.
Geography decides whether a parenting plan survives. A schedule that ignores the drive between Clarke Road and Clarcona can fail on the first rainy school morning at Ocoee High. We build time-sharing around how west Orange actually moves, with exchange times and places both parents can keep.
What the Process Looks Like From Ocoee
- One free ten-minute call. You tell us what's happening, and we tell you honestly whether we can help. If we're a fit, the next step is a one-hour consultation with an attorney, $150 prepaid, and you leave it with your total fixed price in writing.
- Filing with the Orange County Clerk. We file your petition with the Orange County Clerk of Courts. Many Florida counties also enter a standing order at filing that sets ground rules for both spouses while the case is open, and we walk you through it if yours does.
- Service and the 20-day clock. Your spouse is formally served and has 20 days to respond under Rule 12.140(a)(1).
- Mandatory disclosure. Within 45 days, both sides exchange financial documents under Fla. Fam. L. R. P. 12.285, so property and support talks rest on facts. One more thing worth knowing: in a fully agreed case, your spouse typically accepts service instead of being formally served, and the two of you can often waive the document exchange by agreement, which is part of why agreed cases move faster.
- Mediation, then the final hearing if needed. Most cases settle in private mediation with an experienced mediator both sides choose. Life at the Starke Lake waterfront keeps its rhythm the whole way through. If yours needs a judge, we request a final hearing at the Orange County Courthouse.
Counselors and Financial Planners Near Ocoee
When a marriage ends, the emotional work and the money work run on parallel tracks. Counseling helps each person, especially the kids, absorb the change without every disagreement turning into a court filing. Financial planning turns a pile of statements into a clear picture of what the household owns and owes. Counselors and planners are worth lining up early, before mediation, and we can talk through what kind of help fits your situation on the first call. If faith is part of how you get through hard seasons, our Chaplain Care Service is available too.
Questions Ocoee Parents Ask Us
Where does an Ocoee divorce case actually get heard?
At the Orange County Courthouse, 425 N. Orange Ave., in downtown Orlando. There's no family courtroom in Ocoee. The Ninth Judicial Circuit handles the case downtown, about 25 minutes away via Silver Star Road and the 408.
Do I really have to take a class to get divorced?
If you have minor children, yes, Florida requires a parent education course before the case finishes. It's a one-time course, not therapy and not a test. We tell clients to complete it early so the case never waits on it.
Will one of us automatically get the kids most of the time?
No. Since July 1, 2023, Florida starts from a rebuttable presumption that equal time-sharing is in the children's best interest. Courts decide parental responsibility and time-sharing under Fla. Stat. § 61.13. Those are the terms the statutes use for what most people search as custody, and the presumption can be overcome with evidence. The final schedule still has to fit school mornings and two sets of work hours.
What if my spouse won't show me the accounts?
Both spouses must exchange financial documents within 45 days under Rule 12.285. Bank statements, tax returns, and account records come out early, and hiding them has consequences in court.
Who keeps the house?
Neither spouse automatically. Florida divides marital property under Fla. Stat. § 61.075, starting from a premise of an equal split. The practical question is usually whether one paycheck can carry the mortgage, or whether a sale or buyout makes more sense.
How long will this take?
A typical uncontested case runs about three months. Fla. Stat. § 61.19 allows a final judgment as early as 20 days after filing, though few cases move that fast. We scope a standard contested case at seven months or settlement. That is how we set the fixed price, not a promise about speed.
