After decades of marriage, this was never the plan. In a town built around the Penney Retirement Community, a late-life divorce raises questions many people never expected to face: survivor benefits, health coverage, a fixed income split between two homes. We answer them plainly and gently, for one fixed fee quoted in writing before you hire us.

The Plain-English Answer for Penney Farms
Florida is a no-fault state. A Penney Farms divorce begins when one spouse files a petition with the Clay County Clerk stating the marriage is irretrievably broken. No one has to prove fault, and age or length of marriage never bars a filing. The court needs two things:
- Grounds: the marriage must be irretrievably broken, the no-fault standard set by Fla. Stat. § 61.052.
- Residency: at least one spouse must have lived in Florida for the six months before filing, under Fla. Stat. § 61.021.
Local pro tip: The Clay County Courthouse sits roughly 10 to 12 minutes east on SR 16, the same road that runs through town. Even so, most of a divorce happens on paper and by phone.
Ten Minutes East on SR 16, and We Handle the Rest
Your case would most likely be heard at the Clay County Courthouse, 825 N. Orange Ave. in Green Cove Springs, about 10 to 12 minutes east on SR 16 from your front door. We work Clay County cases from our Jacksonville office, and even that short drive is rarely needed, since most filings move electronically.
The town J.C. Penney founded in 1922 is mostly the retirement community and the quiet streets of the Memorial Home Community Historic District, which means divorces here tend to turn on retirement accounts, the marital home, and pension survivor benefits rather than school calendars. Those are details worth preparing carefully.
What the Process Looks Like From Penney Farms
- One free ten-minute call. A quiet, private conversation from home. If we're a fit, the next step is a one-hour consultation with an attorney, $150 prepaid, and you leave it with your total fixed price in writing.
- Filing with the Clay County Clerk. We file your petition with the clerk in Green Cove Springs, usually electronically. Many Florida counties also enter a standing order at filing that sets ground rules for both spouses while the case is open, and we walk you through it if yours does.
- Service and the 20-day clock. Your spouse is formally served and has 20 days to respond under Rule 12.140(a)(1).
- Mandatory disclosure. Within 45 days, both sides exchange financial documents under Fla. Fam. L. R. P. 12.285, including the pension and retirement records that decide most late-life cases. One more thing worth knowing: in a fully agreed case, your spouse typically accepts service instead of being formally served, and the two of you can often waive the document exchange by agreement, which is part of why agreed cases move faster.
- Mediation, then the final hearing if needed. Most cases settle in private mediation with an experienced mediator both sides choose. If yours needs a judge, we request a final hearing at the Clay County Courthouse.
Counselors and Financial Planners Near Penney Farms
Even in a town this small, the two most useful companions to a divorce lawyer are a counselor and a financial planner. Counseling gives you somewhere private to process a late-life separation, which often carries grief the paperwork never touches. Financial planning matters even more here, because late-life divorces turn on retirement accounts, survivor benefits, and fixed incomes. Both are a short drive away in Green Cove Springs. If faith is part of how you get through hard seasons, our Chaplain Care Service is available too.
- Sandy Ann Currie, LMHC, Green Cove Springs, (904) 395-2693. Over 20 years of experience with adults and couples, a short SR 16 drive away.
- Cheryl Walker, MS, LMHC, Green Cove Springs, (904) 320-0272. A relationship-issues focus for clients working through separation.
- PCP Financial Services, 91 Branscomb Rd., Green Cove Springs, (904) 406-0188. An independent financial services office, useful for retirement-division questions.

Questions Penney Farms Residents Ask
Does Florida still award permanent alimony?
No. Florida ended permanent alimony in 2023. Fla. Stat. § 61.08 now sets out other forms of support, including durational and rehabilitative support, and the length of the marriage still shapes what fits, which matters a great deal after a long one.
Does my spouse automatically get half my retirement?
No. Florida has no automatic half. Only the portion earned during the marriage is divided, under Fla. Stat. § 61.075, starting from a premise of equal and weighing the full estate, including survivor benefit elections that deserve careful attention.
What happens to my health coverage?
Coverage through a spouse's plan usually ends at divorce, so we plan for the replacement before anything is signed. For older clients, the timing of the final judgment and the cost of new coverage belong in the settlement math from the start.
What if I never handled the finances?
Both spouses must exchange financial documents within 45 days under Rule 12.285. You don't have to start the case already knowing everything. Statements, tax returns, and retirement records come out early, on a deadline.
How long will it take?
A typical uncontested case runs about three months. Fla. Stat. § 61.19 allows a final judgment as early as 20 days after filing, though few cases move that fast. We scope a standard contested case at seven months or settlement. That is how we set the fixed price, not a promise about speed.
